Risk Disclosure
Â
**Last Updated: March 29, 2026**
PLEASE READ THIS RISK DISCLOSURE STATEMENT CAREFULLY BEFORE USING FSS TRADER. BY USING THE SOFTWARE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND ACCEPTED THE RISKS DESCRIBED HEREIN.
---
1. Futures Trading Risk
Trading futures contracts, including Micro E-mini S&P 500 (MES) contracts, involves a high degree of risk and is not appropriate for all investors. Futures are leveraged instruments, which means:
- You can lose more than the amount you initially deposit or invest
- Small market movements can result in large gains or losses relative to your margin
- You may be required to deposit additional funds on short notice to maintain your positions (margin calls)
- Failure to meet a margin call may result in your broker liquidating your positions at a loss
You should only trade with capital you can afford to lose entirely.
---
2. Automated Trading Risk
FSS Trader executes trades automatically based on pre-programmed rules. Automated trading systems carry additional risks beyond manual trading, including but not limited to:
- Software errors or bugs that cause unintended orders to be placed
- Connectivity failures between the Software and Interactive Brokers Gateway that may prevent orders from being placed, modified, or cancelled
- Latency and execution slippage — actual fill prices may differ from intended prices
- Data feed errors — the Software relies on market data from Interactive Brokers; inaccurate or delayed data may result in incorrect signals
- System outages — your computer, internet connection, or IB's servers may go offline during trading hours
- Unexpected market conditions — the Software's strategies may behave in ways not anticipated during development or backtesting
You are responsible for monitoring the Software during trading hours. We strongly recommend you regularly review open positions, P&L, and system status while the bot is running.
---
3. Backtested Results Are Not a Guarantee
Any backtested performance results presented in the Software's marketing materials, documentation, or interface are hypothetical and have significant inherent limitations:
- Backtested results are calculated with the benefit of hindsight and do not reflect actual trading
- They do not account for real-world factors such as slippage, commissions, partial fills, or liquidity constraints
- Market conditions change over time; a strategy that performed well historically may perform poorly or fail in the future
- Past performance — whether live or backtested — is not indicative of future results
No representation is made that any account will or is likely to achieve profits or losses similar to those shown in backtested results.
---
4. No Guarantee of Profit
FSS Trader makes no guarantee, warranty, or representation of any kind regarding:
- The profitability of any trading strategy included in the Software
- The accuracy or completeness of any signals generated by the Software
- Any specific trading outcome
You may lose your entire trading account balance while using this Software.
---
5. Regulatory Considerations
Futures trading in the United States is regulated by the Commodity Futures Trading Commission (CFTC)Â and the National Futures Association (NFA). You are responsible for understanding and complying with all regulations applicable to your trading activity in your jurisdiction.
FSS Trader is not registered with the CFTC, NFA, SEC, or any other regulatory body as an investment advisor, commodity trading advisor (CTA), or broker-dealer. Nothing in the Software or its documentation should be construed as investment or trading advice.
---
6. Third-Party Brokerage Risk
The Software requires an Interactive Brokers ("IB") account to function. You accept all risks associated with your IB account, including:
- IB's margin policies, fees, and commission structures
- IB platform outages or technical failures
- Changes to IB's API or software that may affect the Software's functionality
- IB account restrictions, suspensions, or closures
We are not affiliated with Interactive Brokers and have no control over their platform or policies.
---
7. Technology and Cybersecurity Risk
- The Software runs on your personal computer and is only as secure as your own system
- You are responsible for maintaining the security of your computer, IB account credentials, and license key
- We are not responsible for losses arising from unauthorized access to your computer or brokerage account
